TTAB rejects SINFUL ZINFANDEL as confusable with ZINFUL

I’m back from maternity leave and back “off the wagon”, so to speak, with a post about one of my favorite beverages – red zinfandel.

The USPTO recently refused registration of the mark SINFUL ZINFANDEL for wine citing likelihood of confusion with the mark ZINFUL.

The Board found significant that the dominant part of the mark, “sinful”, rhymes with “zinful” and that the words look similar.  The Board also found that “zinful” evokes something “sinful” in addition to calling to mind “zinfandel.”  Thus, The Board found the commercial impressions of the marks were similar and upheld the refusal to register.
